The Employment Relations Authority has issued a practice note which applies from 1 August 2016 for costs in the ERA.
The ERA has traditionally used a notional daily tariff approach as the starting point for considering a costs award.
The practice note sets the daily tariff for matters lodged in the ERA from 1 August at $4,500 for the first day of the matter and $3,500 for any subsequent day of the same matter.
It says that typically the ERA will not deal with costs until the substantive determination has been made and thereafter costs will fall for disposition either by negotiation between the parties or by determination of the Authority.
